 | The Immortal Person A corporation is a legal entity (technically, a juristic person) which has a separate legal personality from its members. The defining legal rights and obligations of the corporation are: (i) the ability to sue and be sued; (ii) the ability to hold assets in its own name; (iii) the ability to hire agents; (iv) the ability to sign contracts; and (v) the ability to make by-laws, which govern its internal affairs.[1] Other legal rights and obligations may be assigned to the corporation by governments or courts. These are often controversial.[2] Stewart Kyd, the author of the first treatise on corporate law in English, defined a corporation as "a collection of many individuals united into one body, under a special denomination, having perpetual succession under an artificial form, and vested, by policy of the law, with the capacity of acting, in several respects, as an individual, particularly of taking and granting property, of contracting obligations, and of suing and being sued, of enjoying privileges and immunities in common, and of exercising a variety of political rights, more or less extensive, according to the design of its institution, or the powers conferred upon it, either at the time of its creation, or at any subsequent period of its existence." Currently, the modern business corporation is the dominant type of corporation. In addition to its legal personality, the modern business corporation has at least three other legal characteristics: (i) transferable shares (shareholders can change without affecting its status as a legal entity), (ii) perpetual succession capacity (its possible continued existence despite shareholders' death or withdrawal), (iii) and limited liability (including, but not limited to: the shareholders' limited responsibility for corporate debt, insulation from judgments against the corporation, shareholders' amnesty from criminal actions of the corporation, and, in some jurisdictions, limited liability for corporate officers and directors from criminal acts by the corporation).[3] The modern business corporation's prevalence often obscures the fact that for years other corporate business entities existed, before the emergence of the modern business corporation. Investors and entrepreneurs often form joint stock companies and then incorporated them to facilitate conducting business; as this business entity now is prevalent, the term corporation often is used to specifically refer to such business corporations. Corporations may also be formed for local government (municipal corporation), political, religious, and charitable purposes (not-for-profit corporation), or for government programs (government-owned corporation). As a generic legal term, 'corporation' means any group of persons with a legal personality. Tompkins, 304 U.S. 64, changed our justice system from one of public law to one of public policy and determined that everything is in Commerce. That took away our Constitutional rights replacing them with corporate government rules and regulations. Governments and courts are not real governments and courts; they are corporate fictions. Yes, they are all for-profit corporations! In today's "courts" we are now guilty until proven innocent because governments, and the courts, presume that we are juristic, corporate persons subject to their laws, rules, regulations, ordinances, codes etc. However, in commerce, everything is done by contract and unlike entities cannot be joined in commercial contract. If you cut corporations, governments, courts or banks, they do not bleed. They are corporate fictions. If you get cut you do bleed. You are real. Therefore you and the governments, courts and banks are unlike entities and cannot be joined in Commerce. You are real, they are fictions. Soooooo, our government corporations created and offered to us the STRAW MAN as the optional commercial instrument/entity to enable us to move and operate in Commerce and changed us into "corporations" so they could do business with us in Commerce. They invented the STRAW MAN, our name in ALL CAPITAL LETTERS, a fictitious entity, a corporation! STRAW MAN. A "front"; a third party who is put up in name only to take part in a transaction. Nominal party to a transaction; one who acts as an agent for another for the purpose of taking title to real property and executing whatever documents and instruments the principal may direct respecting the property. You have God given rights which are protected by the constitution, the corporate citizens' "civil rights" are granted by government, are called privileges, and can be taken away by government at any time. For example, living souls have the right to keep and bear arms; "citizens", in the "colorable" sense of the word by which government operates in relation to you and me, have no such right, etc., etc.. Commentary: By the 'rope of Allah' is meant that agreement and covenant which was drawn up between us and the Almighty Allah - the covenant of the Quran. This opinion is based on a hadith in which the Prophet, peace be upon him, said: "The Book of Allah: It is the Rope of Allah that has been extended down from the heavens to the earth." (Ibn Jarir, Qurtubi) Imam Razi comments: "Since the path that believers are required to take is a very narrow one, the likelihood of a person slipping off always remains high, except in case of him who holds a rope that runs across." The command to hold fast to the Quran implies that we have been directed to follow the code prescribed through the Quran for our individual as well as collective life. In every difficult situation involving our convictions and ideaology the Quran should be our guiding star for steering us to safety. By 'be not disunited' it is implied that we must not lose our grip on the Rope of Allah and fall into the snare of prejudice by splitting into groups led by different Imams and leaders, whereby truth and guidance, instead of being radiated directly by the Quran might appear to become the private property of certain individuals and personalities. Mufti Shafi remarks: "When we speak of unity of ranks, we know that it cannot be attained without the unity of ideas, faiths and objectives. That will come from the Quran and the Sunnah. It is only when we hold fast unto them, accepting them as the sole criteria, guide and judge, that the much sought after unity of ranks, will be achieved. Every other method will fail miserably."
