August 21, 2009, SUN-TIMES Riverdale police fatally shoot unarmed man This story has vanished from the web, so I uploaded it here to insure it would not be forgotten while police "investigate". August 21, 2009, Chicago Sun-Times riverdale-police-fatally-shoot-man An unarmed man was fatally shot by police in Riverdale, Illinois, a south suburban town of Chicago. In a news release, Riverdale police say the victim, Brandon Harper, 23, a Riverdale resident, was killed in the incident. The shooting occured about 11 30 a.m Thursday in the 14500 block of Michigan Avenue as a Riverdale police officer observed three men sitting in a parked car in an area police say is known for drug and gang activity. The officer approached the vehicle to investigate, and asked the occupants several times to show their hands. When the driver refused, the officer, "in fear for his life," fired one shot, striking Harper in the chest, killing him. Harper was pronounced dead at Ingalls Memorial Hospital in Harvey at 12 18 p.m., according to the Cook County medical examiner's office. Illinois State Police and the Cook County State's Attorney's Public Integrity Task Force are investigating the shooting. If an officer has engaged you, KEEP YOUR HANDS IN PLAIN SITE. Maintain a calm demeanor. Do not say, or do anything that could be construed as threatening. Disarm any fear of violence by establishing your lawful and peaceful intentions. Instruct the officer to identify him or her self and ask if they intend to uphold their oath as a peace officer. If you have been stopped by an unmarked police car and / or plain clothed officer, you may demand an officially marked unit and uniformed officers respond to your location. The officers must produce three forms of identification upon demand; badge, business card, and official photo ID. Unless you are driving a motor vehicle, are at a port of entry, or boarder crossing, YOU HAVE NO OBLIGATION TO PRODUCE I.D. KNOW YOUR RIGHTS EDUCATE OTHERS You have none if you do not understand them or cannot assert them effectively. Stick to the basics: (and say nothing else) "I do not consent to any searches." "I mean no disrespect, sir, but I will not be answering any of your questions." "I can't comment on that" "I do not wish to enter into any conflict." "Under what authority are you acting?" "I do not consent to that." "Am I free to go?" "Am I being detained?" "Am I under arrest?" "Is that a lawful order?" "I object to this." "I wish to go about my business." "Officer, please note, for and on the record, I am cooperating under protest and acting under duress. If asked 'Do you understand?' do not respond in the affirmative. By answering yes, you submit yourself as subordinate and agree to (stand under) their terms. Should you say no, that would put you in conflict and invite mediation (court hearing). Instead say "I do not accept" "I take exception" to that and / or ask "am I obliged to understand?"
