CASSELBERRY, Fla. -- Eyewitness News has learned a lawsuit will soon be filed against a Casselberry gun range where a woman rented a gun over the weekend and shot her son to death before shooting herself. The woman's family is claiming that the woman should not have been allowed to rent a gun in the first place. Attorneys are ready to file a lawsuit against the Shoot Straight Gun Range after Marie Moore gunned down her own son and committed suicide with a rented gun on Sunday. The lawsuit will focus on an allegation that the gun range had previously booted Moore out during a previous suicide attempt. "If there wasn't a gun range in the world she would have done what she did another way, said Larry Anderson, gun range manager. Anderson says Moore and her son acted normally prior to the shooting. The disturbing surveillance video captures everything, while another customer looks on in disbelief. In suicide notes and voice messages Moore suggested her previous attempt was thwarted. "Under no circumstances did this woman come into Shoot Straight and was banned for attempting suicide. That scenario did not happen," said Anderson. Legal papers will be filed on behalf of victim Mitchell Moore's father and led by high-profile attorney John Morgan. Anderson said there are lots of reasons for customers to be asked to leave the gun range, including alcohol and drug use as well as strange behavior. He says if Marie Moore had ever been kicked out of the gun range it was not for trying to shoot herself. "She may have left her house with the intention of committing suicide and changed her mind, then went home and said, 'they banned me from shoot straight for trying,'" he said. However gun ranges aren't required to conduct background checks on people when they rent guns only when they buy them.
