City of Miami Springs/Miami-Dade County Title II Violation (Sidewalk accessibility)
Description:
The access barriers shown here at 1401 North Royal Poinciana Blvd. in Miami Springs, Florida, expose disabled persons to many hazards, including forcing wheelchair users to roll in the streets alongside vehicular traffic. The City of Miami Springs and the County of Miami-Dade have been required for many years to identify and remedy such access barriers but have failed and refused to meet this obligation. Miami-Dade County provides for public use an extensive network of physical facilities, including many public sidewalks, crosswalks, pedestrian crossings, bicycle/pedestrian pathways, and other walkways referred to as "pedestrian rights of way". These systemic failures create significant barriers for persons with disabilities. As a result of these barriers, disabled pedestrians experience unsafe travel using these pedestrian rights of way. These actions are in violation of Title II of the Americans with Disabilities Act, and section 504 of the Rehabilitation Act of 1973, which requires public entities and entities receiving federal funds to provide equal access to public services for people with disabilities.
