2009 budget speech from sinhala and tamil...Sri Lankan President Mahinda Rajapaksa Thursday unveiled next year's budget that proposes to hike defence spending by nearly seven percent, demanding that the Tamil Tigers surrender their weapons to avoid making the military do so.This is the fourth budget to be presented by President Rajapaksa, who is also the minister of finance, after he was elected to office November 2005.Even at this decisive moment, I request the LTTE (Liberation Tigers of Tamil Eelam) terrorists to lay down their weapons and enter the democratic process. If they do not do so, our troops will take steps to bring them to their knees, Rajapaksa, also the minister of defence and commander-in-chief of the armed force, said while making the budget speech. According to provisional figures presented to parliament in early October, the government plans to raise defence spending to a record of 177.1 billion rupees (approx 1.6 billion dollars) in 2009 from 166.44 billion rupees in 2008.Insisting that the military onslaught would 'clear the (island's) north from the LTTE like in the east, President Rajapaksa said the provincial council election would be held (in the north also) to restore democracy. |

President Mahinda Rajapaksa calls on the UNP to refrain from avenging innocent civilians obstructing international aid. UNP reprisals are aimed at averting the flow of foreign aid to Sri Lanka. (30/03/2008) Addressing the 18th SLFP Convention at Temple Trees this morning, he claimed it was the innocent civilians who are hindered as a result. The President noted that there is a posse, which raise voices abroad that human rights are violated in Sri Lanka. Not only the UNP, but some of their own leaders are canvassing to prevent the flow of aid to Sri Lanka and also to thwart the GSP Plus relief granted by Europe. These elements are not rising up against him or the government but avenging the civilians. They can take revenge from him and not from the people. This was the message that he had to give them. The theme of the Convention was "Building a peaceful Country with local economy In the forefront". A highlight was the adoption of 10 resolutions. These included expressing gratitude to the international community, the All Party Conference proposals, granting relief by de-escalating the cost of living, proposal on eastern local polls and saluting the gallant soldiers. President Rajapakse handed over certificates to electoral organizers, who recruited the most number of members to the SLFP last year. 14 such organisers were honoured. The President further said the government was able to fulfill pledges given to the people through the Mahinda Chintana. 28 political parties supported him to become President and a pledge was given that the North and East will be liberated from the terrorists. He observed that the government had fulfilled this task, safeguarding the country's unitary status. Ministers Maithripala Sirisena and Jeyaraj Fernandopulle also expressed their views. Avasiya Arikai 41: Mahinda Rajapakse Vs J. R. Jeyawardane The events of July 1983 are poignant for the entire Tamil population around the world. Between July 24 and 29, Tamils were systematically targeted with violence in Colombo and many other parts of Sri Lanka. Sri Lankan Governments officials categorized the violence as uncontrollable race riots instigated by the killing of 13 Sinhala soldiers on the night of July 23. However, history and the course of events during Black July illustrate the Sri Lankan Government's undeniable involvement in the genocidal acts against Tamils. July 24 (Day 1): At 1 o'clock in the morning of July 24, the army rounded up hundreds of Tamils in Trincomalee, Mannar, and Vavuniya in the Northeast who had fled the anti-Tamil riots of 1977 and 1981. These Tamils were forcibly taken and left without possessions in the central hills. Before the riots broke out in Colombo, the army in Jaffna went on rampage killing 51 innocent Tamil civilians. In Trincomalee, similar violence broke out as members of the Navy randomly shot at civilians and burnt down Tamil property. In the evening in Colombo, the state funeral was being organized for the soldiers. Thousands of people arrived at the cemetery but the bodies failed to appear. After waiting several hours, much of the crowd objecting the burial in Kanatte and demanded the bodies to be returned to the next of kin. As the large crowd began to leave the grave, a new group of people (identified as government gangs) entered the Borella junction and raised anti--Tamil cries. As the anti-government cry subsided and anti-Tamil cries became dominant, arson and murdering of Tamils broke out. July 25 (Day 2): After the midnight lull, mobs were led by people with voter registration lists in hand torched Tamil homes, looted and destroyed Tamil businesses. All traffic was searched, and any Tamils found were killed, maimed, or burned alive. Cyril Matthew, Minister of Industries, was witnessed directly pinpointing shops to be burned down. Many policemen were deployed throughout the city; however, they tacitly stood and watched on. Witnesses recall lorry loads of armed troops leisurely waving to looters who waved greetings back. Curfew was only declared by the President late in afternoon after the worst was over. However, the violence continued unabated. Tens of thousands of Tamils who were homeless, sought refugee in schools and places of worship. In Welikade prison, 35 Tamil political prisoners who were awaiting trail under the Prevention of Terrorism Act, were massacred by Sinhalese prisoners with the complicity of jail guards using spikes, clubs and iron rods. The violence spread rapidly throughout the country, engulfing towns like Gampaha, Kalutara, Kandy, Matale, Nuwara Eliya and Trincomalee. One town was completely wiped out - the Indian Tamil town of Kandapola, near Nuwara Eliya. July 26 (Day 3): Government imposed a strict censorship of media reporting on the anti-Tamil violence. Word spread of Sri Lanka's state of disorder as eye witness accounts and photographs taken by returning tourists illustrated the scale of violence. They described how Tamil motorists were dragged out of their vehicles and hacked to pieces while others were drenched with petrol and set alight in full view of the security forces. The International Airport in Colombo was closed. July 27 (Day 4): 17 more prisoners at Welikade Prison were hacked to death just two days after the prison massacre. The surviving 36 prisoners are transferred to other prisons. Rioting continued and the curfew is extended. Witnesses of the violence reported that charred corpses of Tamil victims lined the streets of Colombo, some mutilated with X's. July 28 (Day 5): President J.R. Jayewardene addressed the nation for the first time since the anti-Tamil pogroms, only to fan the flames of anti-Tamil sentiments by stating that anyone who advocated for separatism would lose all their "civic rights". He states, He states, "....the time has now come to accede to the clamour and natural request of the Sinhala people to prevent the country from being divided." Vigilantes set up make-shift roadblocks in villages across the island, searched cars and buses for Tamil passengers. In one incident, a Sinhalese mob burnt to death about 20 Tamils on a minibus as European tourists look on in horror. July 29 (Day 6): Tamils in Colombo began evacuating by cargo ship to the Northern city of Jaffna. Hundreds more internally displaced persons waited anxiously for the next cargo ship to transport them to Jaffna. July 30 (Day 7): Violence began to dissipate. There was an extreme food shortage in Colombo and across the island as a result of the week long violence. Post-Riots: Tamils fearing persecution, flea their homeland for Western countries. Liberation Tigers of Tamil Eelam (LTTE) is the armed rebellion organisation fighting for the independence of Tamil Eelam. It is a unique organisation in the world in the following aspects. 1. Every cadre wear a cyanide capsule around the neck and commit suicide to avoid divulging vital information. 2. LTTE is the only rebel organisation which has naval and air wings known as Sea Tigers and Air Tigers respectively. 3. All the cadre wear uniform. Why did Tamils in Sri Lanka want Tamil Eelam ? Sri Lanka, which was renamed in Sinhala in 1972, had been called as Ceylon by British during colonial times. Before 1833, the Tamil people were under different administration. They had their own kingdoms, culture and language which are very different from those of Sinhalese until 1505. The first colonial invasion took place in 1505. British brought Tamils and Sinhalese under one administration in 1833 and called this new colony as Ceylon. When the British left in 1948, the 20% Tamils were left with 80% Sinhalese within a unitary country where the decisions were taken by democratic parliament system. Under this system, racially polarised Sinhalese and Tamils were ruled by the constant majority of Sinhalese against the democratic wishes of Tamils as Tamils were the constant minority. Reference: Document submitted by 17 NGOs in 50th Sessions of UN Commission on Human Rights:"There is a need to recognise that the deep divisions between the Sri Lanka government and the Tamil people cannot be resolved by the use of force against Tamil resistance. The Tamil population in the North and East of the island, who have lived from ancient times within relatively well defined geographical boundaries in the north and east of the island, share an ancient heritage, a vibrant culture, and a living language which traces its origins to more than 2500 years ago. ...Before the advent of the British ..., separate kingdoms existed for the Tamil areas and for the Sinhala areas in the island. The Tamil people and the Sinhala people were brought within the confines of one state for the first time by the British in 1833. After the departure of the British in 1948, an alien Sinhala people speaking a language different to that of the Tamils and claiming a separate and distinct heritage has persistently denied the rights and fundamental freedoms of the Tamil people. .. ! It is ...our view that the Secretary General should consider invoking his good offices with the aim of contributing to the establishment of peace in the island of Sri Lanka through respect for the existence of the Tamil homeland in the North East of the island of Sri Lanka and recognition for the right of the Tamil people to freely determine their political status." LTTE not a terrorist organisation Karen Parker Ms.Karen Parker is an attorney specializing in international law, humanitarian (armed conflict) and human rights law. She is a member of the California Bar and has a J.D.(Honours-1983) from the University of San Francisco School of Law and a Diploma (cum laude -1982) in Droit International et Droit Comapare des Droits de l'Homme (Strasbourgh, France). " I have been asked to set out my views on whether the LIBERATION TIGERS OF TAMIL EELAM (LTTE) is a "terrorist" organization. I state categorically that the LTTE is not a "terrorist" organization, but rather an armed force in a war against the government of Sri Lanka. Characterization of the LTTE as a "terrorist" organization is politically motivated having no basis in law or fact. This memorandum provides a brief legal analysis to support my view. There is a war in Sri Lanka. By war I mean that there is armed conflict occurring between two parties. An armed conflict is defined by the use of military material in an organized fashion by atleast two groups organized into military fighting forces fighting each other. The LTTE are organized militarily, with a military commander and military chain of command. The LTTE uses traditional, modern military weaponry in its combat against the military forces of the government of Sri Lanka. The LTTE uses a variety of military tactics, including open warfare, raids or guerrilla warfare. The government armed forces use similar military mean against the armed forces of the LTTE. Most armies in the past 200 years have utilized essentially the same tactics. The war in Sri Lanka may be characterized as either a civil war or a war of national liberation in the exercise of the right of self- determination. A civil war exists if there is armed conflict inside one country between government armed forces and at least one other force having an identifiable command and having sufficient control over territory to carry out "sustained" and "concerted" military action and the practical capacity to fulfil humanitarian law obligations. The LTTE has clearly met this test for more than ten years. A war of national liberation exists if armed conflict exists between the armed forces of a government against the armed forces of a people that has the right to self-determination. In my view, the war in Sri Lanka is a war of national liberation because the Thamil people have the right to self-determination. This is because the Thamil people, the original in habitants of the north and east of the island of Ceylon, had their own state complete and separate from the Sinhala state prior to colonization by the British. The Thamil people, primarily Hindu, and secondarily Christian and Muslim, speak their own language and have their own traditions and customs. The Sinhala people are primarily Buddhist, and secondarily Christian and their traditions and customs reflect that heritage. With the forced unitary rule, first as a result of colonization and then under the post-colonial Sinhala majority rule, the Thamil people were increasingly threatened. In the late 1970s, after nearly thirty years of attempted peaceful resolution to the many points of profound differences, the Thamil people began forming armed defence forces. At present, Thamil forces are consolidated in the LTTE, which continues to defend Thamil areas in a war against the Sinhala government's armed forces, "Home guards" and other armed entities. If the war in Sri Lanka is a civil war, outside states are required to be neutral- a civil war is by definition an internal affair of state. This is known as the duty of neutrality. If the war is a war of national liberation, outside states are required to support the side with the self-determination claim the Thamil side. This is because of the jus vogens nature of the right to self-determination. This does not mean that another state must provide direct aid to the Thamil people or the Thamil armed force. However, other states must not engage in any activity with the Sinhala government that in any way undermines the realization of self-determination by the Thamil people. Both parties to the armed conflict on the island of Ceylon violate the rules of armed conflict or humanitarian law. However, the mere fact that one side or the other violates humanitarian law norms does not deny either the rights or duties of combatant force. Accordingly, the LTTE may not be called a "terrorist" organization because in the course of the armed conflict, some of its soldiers have violated the rules armed conflict. In the same light the government cannot be called "terrorist" state because some of its military operations have violated the rules of armed conflict. Neither side, of course, can be considered to violate humanitarian law for carrying out military actions. I have noted "condemnation" of the LTTE by the government and others for carrying out military operations that are not prohibited in humanitarian law. For example, the LTTE shot down a number of air planes and sank a number of ships of the of the Sri Lankan forces . These actions were called "terrorist" by the government of Sri Lanka. These are not violations of humanitarian law and therefore cannot be characterised as "terrorist" . I do note, however, the rampant disregard of humanitarian rules by the government forces in , persistent and repeated military operations against hospitals, schools, market places, churches and locations with a strong historical and cultural significance to the Thamil people. I also note the difficulty in establishing the culpable party(ies) in a number of situations where the LTTE has been accused by the government of killing civilians. This is not to say the LTTE have not resorted to killing civilians. However, the fact that the government accuses the LTTE does not mean the LTTE actually carried out the acts in question. The government's rejection of impartial, international fact finding makes ascertaining the truth ever more difficult. The international court of Justice decided that all states have an obligation under Article 1 common to the Geneva Conventions to, "ensure respect" for the Geneva Convention even when not directly or indirectly involved in a conflict. From my point of view, this requirement mandates at least that the international community insist that the government of Sri Lanka allow both humanitarian relief to all victims of the conflict and international, impartial fact-finding to take place." |
